This End User License Agreement ("Agreement") is a legal agreement between you ("End User") and WestVet ("Provider") for use of the information and software made available through this website ("Website"). By using the Website, End User agrees to be bound by the following terms and conditions ("Terms").

WHEREAS, This Agreement refers to all content contained within the Website including but not limited to source code, online/electronic documentation, graphics, images, text, software, and any associated media or printed materials that relate to the Website content and applications. By using the Website and the software applications in any way, including, without limitation, use of any of the services, downloading of any materials, or merely browsing the site, End User agrees to be bound by the terms and conditions of this Agreement. Provider reserves the right to make changes to the materials and services at this site, including the prices and descriptions of any products listed herein, at any time without notice.

1. License. Subject to the terms and conditions hereof, End User is hereby granted a nonexclusive, nontransferable, revocable, limited license ("License") to utilize this Website. End User understands that License has been granted for personal use only and agrees to not apply License for any commercial use or exploitation. The rights established herein constitute a license and not a transfer of title. End User agrees that the Website is protected by copyrights, trademarks, or other proprietary rights and laws and any such intellectual and authoring rights are exclusively held by WestVet.

2. Restrictions. In the event the End User or one of his collaborators performs any of the Prohibited Actions listed below, End User will be in violation of the Terms of the Agreement, no longer have any rights to access or use this Website, and will be subject to investigation and/or prosecution by Provider. Provider reserves the right to take any action or remedy deemed necessary and available by law or equity for violations perfomed by End User within the scope of this Agreement. Under License Restrictions the End User cannot:

--remove any label, sign, or written notice regarding the Website, copyright, and intellectual property rights
--reverse engineer, dismantle, decompile or hack Website
--modify, copy, republish, or create object deriving from this Website
--rent, lend, or in any other way transfer the licensed rights to operate the Website
--utilize the Website for any illegal, immoral, or violent operation

Any attempt at using the Website not in accordance with the Agreement or in performing the aforementioned Prohibited Actions will be considered a violation of the Terms of this Agreement.

3. Third Party Content. This Website may contain content or links from Advertisers or Third Parties. End User agrees that Provider is not responsible for the accuracy of such content. Provider assumes no liability for any errors, omissions, misstatements of law, slanderous remarks, or any other claims or representations made by Advertisers or Third Parties. End User acknowledges that any information or opinions displayed on the Website or via links to the Website in the Third Party does not reflect any beliefs held by or endorsements made by the Provider.

4. Not Medical Advice. Any information or content made available through the Website, including but not limited to text, graphics, software applications, services, and Third Party opinions, submissions, websites, or links is not intended to be and does not constitute medical veterinary advice or the formation of any doctor-client relationship. End User agrees that use of the Website is at his/her own risk and that any information submit to the Website is not deemed to be confidential.

5. Subscription. Sections of the Website may require the submission of certain information by End User (the "Subscription"). When required, End User agrees to submit accurate and complete data, to be responsible for not allowing others to access the Website with his/her Subscription information, and to prevent such unauthorized use. End User agrees that a Subscription is for individual use only and that multiple use of one Subscription is not permitted by Provider. Hence, one Subscription is required per station/user/operator. 6.Warranty Disclaimer. Under no circumstances shall Provider be liable for any unauthorized use of any content of any person, or any use of the Website to develop, distribute, or use any material that is defamatory, slanderous, libelous, or obscene that portrays any person in a false light, that constitutes an invasion of any right to privacy, or an infringement of any right to publicity, that gives rise to any breach of contract involving any third party, or any violation of any foreign, federal, state or local statue or regulation, or that otherwise can be reasonable likely to expose Provider or its agents to criminal or civil actions. End User agrees that neither Provider, it's subsidiaries nor any of it's suppliers shall be liable for any loss or damage hereunder, including, without limitation, any inaccuracy of data, errors or omissions in content, loss of profits or direct, indirect, special, incidental, or consequential damages, even if such party has been advised of the possibility of such damages. Provider warrants that it is not responsible for any Third Party content or websites made available through links in this Website. End User accepts the Website provided, as is, without any warranty whatsoever. Provider disclaims that all warranties and conditions, express or implied including without limitation the implied warranties or conditions of merchantable quality, noninfringement, and fitness for a particular purpose.

7. Survival. All provisions hereof relating to proprietary rights and warranties shall survive the availability of the Website, expirations for Subscriptions to the Website, and/or termination of this Agreement.

8. Governing Law and Jurisdiction. This Agreement and performance hereunder shall be governed by the laws of the state of Idaho. The End User agrees to fully comply with all laws and regulations of the United States without regard to conflicts of Law.

9. Severability. Any provision hereof which may prove unenforceable under any law or by any court shall not affect the validity of any other provision hereof.

10. Modifications to Terms. Revisions to these Terms of Use may be posted to the Website at any time at the discretion of the Provider. End User acknowledges that these modifications are effective immediately and that any use of the Website constitutes acceptance of the Terms and any modifications herein.
